The Communist Party of Vietnam’s view and perception of the sovereignty of people is that state power belongs to the people, and people’s central role has been supplemented, fine tuned, and developed in building a socialist state governed by law.

National Congresses of the Communist Party of Vietnam have confirmed the mission to build and fine tune a socialist state governed by law to ensure and promote the people’s right to mastery and the principle “all state power belongs to the people.”

National Party Congresses have clarified the perception of a socialist state governed by law in the relationship between the state and its citizens, focusing on controlling state power, with people overseeing state power.

The 10th and 11th National Party Congress deepened the awareness of building a socialist state governed by law. The 12th National Party Congress firmly adhered to the view of building a socialist state governed by law of the people, by the people, and for the people. The State must adhere to the rule of law in all organizations and operations, with the prime principle being “all power belongs to the people.”

At the 13th National Congress, the Communist Party of Vietnam vowed to build and fine tune a socialist state governed by law which is pure, strong, elite, and effective and serves the people for the cause of national development.

President Nguyen Xuan Phuc said: “Documents of the 13th National Party Congress stated “building and fine tuning a socialist state governed by law of the people, by the people, and for the people and led by the Party is the prime task of reforming the political system. It confirms that the policy is correct and matches current trends, demands, and the national goal of building a strong, wealthy nation with prosperous, happy people.”

The 2013 Constitution institutionalizes the Party's views on upholding the sovereignty of people in building a truly socialist state governed by rule of the people, by the people, and for the people. It stipulates that people exercise state power by representative democracy through people-elected agencies and other state agencies. The Constitution clearly stipulates the constitutional principle that: “In the Socialist Republic of Vietnam, human rights and civil rights in politics, economy, culture, and society are recognized, respected, protected, and guaranteed in line with the Constitution and laws”.

President Nguyen Xuan Phuc said: “The principal factor deciding the success or failure of a socialist state governed by law is the level of people’s participation in the state apparatus. The key to building a socialist state governed by law is to release and fully promote human resources.”

The 2013 Constitution affirms the position and role of leadership and underscores the duty of the Party to serve the people, be overseen by the people, and take responsibility for its activities before the people. The Constitution has defined new human and civil rights.

But the mechanism for people to control the political power of the ruling Party and the State has not been fine tuned and used effectively. The Fatherland Front’s social oversight and criticism function at all levels has not been given due attention, and there are not sufficient legal provisions for controlling state power.

In the future people’s awareness must be improved and the sovereignty of the people in building and fine tuning a socialist state governed by law must be institutionalized and strictly implemented.
