Under the US Constitution, only Congress is granted the power "to regulate commerce with foreign nations,” which cannot be overridden by invoking the President’s emergency authorities.
Upon returning to office earlier this year, President Donald Trump declared a national emergency on US trade as grounds for the new 10% blanket tariff and additional duties targeting about 60 nations that he considers the largest contributors to the US trade deficit. The President later decided to pause tariffs for 90 days in early April to make room for negotiations.
