Can Tho Court’s ruling on property loan contract involving Loh Steve Giang

(VOVWORLD) - The Can Tho municipal People’s Court would like to inform US citizen Loh Steve Giang of a dispute over an asset loan contract, in which in the plaintiff requests the defendant return 6,700,000,000 VND (Six billion seven hundred million VND).

Mr. Loh Steve Giang was born in 1961. His most recent known address is 1505 Grapevin Creck Dr Coppell TX 75019 USA.

In the Decree No. 01/2022/DSST dated January 05, 2022, the court’s judgments were stated as followed:

- The petition of plaintiff Lu Thoai Phuong is accepted.

- Defendant Loh Steve Giang (Giang Son Minh) is obliged to pay Ms. Lu Thoai Phuong VND 6,700,000,000 (six billion seven hundred million dong). 

- Mr. Loh Steve Giang (Giang Son Minh) has to pay interest if there is a delay in the payment per the Court’s judgments according to Article 357 of the Civil Code 2015. The payment effective date begins when Ms. Lu Thoai Phuong filed a request for judgment enforcement.

- Mr. Loh Steve Giang (Giang Son Minh) has to pay judicial entrustment costs of VND 5,000,000 (five million VND) and the cost of signature examination of 4,000,000 VND (four million VND). Ms. Lu Thoai Phuong also paid these two expenses. Mr. Loh Steve Giang (Giang Son Minh) has to refund 9,000,000 VND (nine million VND) to Ms. Lu Thoai Phuong.

- Mr. Loh Steve Giang (Giang Son Minh) must pay 114.7 million VND (one hundred fourteen million seven hundred thousand dong) for first-instance civil court costs.

- Ms. Lu Thoai Phuong will pay the first-instance civil court fee, which is 57,000,000 VND (fifty-seven million dong) according to receipt number 000472 dated December 6, 2017 at the Civil Judgment Execution Department of Can Tho city.

- Ms. Lu Thoai Phuong has the right to file an appeal against the Court’s ruling within 15 days after the decision was announced. The duration for Mr. Loh Steve Giang (Giang Son Minh) to file an appeal against the Court’s ruling is 30 days after the decree is announced. Persons with related interests and obligations have the right to file an appeal against the Court’s ruling within 15 days after the decision comes into effect.

- If the judgment is enforced according to the Article 2 of the Law on Civil Judgment Execution, the related parties have the right to agree on judgment enforcement or to be forced to execute the judgment, according to Articles 6, 7 and 9 of the Law on Civil Judgment Execution. Time for judgment enforcement will comply with the Article 30 of the Law on Civil Judgment Execution.
