(VOVWORLD) -  National Assembly Chairman Vuong Dinh Hue has written an article entitled “Application of Ho Chi Minh Thought in legislation to fine-tune Vietnam’s law-governed socialist State” ahead of the opening of the first session of the 15th NA and the review of 5 years of implementing the Politburo Directive on following President Ho Chi Minh’s ideology, morality, and lifestyle. In his article, Mr. Hue pointed out orientations for legislative activities in building Vietnam’s law-governed socialist state.

NA Chairman Vuong Dinh Hue says HCM Thought on the state, law, and legislative activities are the guidelines for building and fine-tuning Vietnam’s legal system. Applying HCM’s ideology, morality, and lifestyle in legislation plays a crucial role. According to Mr. Hue, Vietnam’s legislative activities must meet the following requirements:

First, legislative activities must provide a legal corridor for the State to perform its activities in line with the Constitution and law. To this end, legislative activities must create institutional breakthroughs to settle problems that arise in a practical and specific manner and ensure legal coverage in all socio-economic aspects.

Second, legislative activities must respect and protect human rights and the specific rights and freedoms of Vietnamese citizens, maintain the relationship between the State and citizens and between the State and society, and ensure human rights in all State and social activities. All activities of the State must respect and protect human rights and create conditions for citizens to exercise their rights under the law.

Third, legislative activities must ensure that state power is organized and exercised under the principles of delegation, coordination, and control of power. Ways to delegate, coordinate, and control state power vary, depending on the State’s organization in different countries, but all must ensure that state power is delegated and coordinated between state agencies in exercising the rights of legislating, exercising power, and carrying out justice. The organization and exercise of power must be controlled tightly by agencies inside and outside the State apparatus.

Fourth, legislative activities must ensure a mechanism that protects the Constitution and law. The foundation of a law-governed state is the Constitution and a democratic and equitable legal system. A mechanism that protects the Constitution and law is a crucial condition to ensure that the Constitution and law are always respected and complied with. Ways to protect the Constitution and law differ between countries but all aim to ensure the supremacy and inviolability of the Constitution and prohibit actions against the Constitution.

Fifth, legislative activities must ensure responsiveness to impacts of the 4th Industrial Revolution. This means legislative activities need to create a legal basis for optimizing the achievements of Industry 4.0 and the benefits this brings to people, businesses, and society.

Sixth, legislative activities must ensure that the law-governed socialist state is placed under the leadership of the Party. This is of profound importance and reflects the nature of Vietnam’s law-governed socialist State.

NA Chairman Hue says that in the coming time, the NA will strengthen the application of President Ho Chi Minh’s ideology to legislation and implementing the Strategy on Building and Fine-tuning Vietnam’s law-governed socialist State until 2030 and Vision to 2045. Vietnam’s legislative activities will focus on fine-tuning laws on national sovereignty, borders, human rights, and citizen rights; organizing a State apparatus that is “of the people, by the people, and for the people”; building a legal foundation that ensures direct democracy, representative democracy, and democracy at the grassroots level; and ensuring sustainable socio-economic development that protects the environment. Vietnam will continue to reform its legislative process; expand democracy in the legislative process to improve the feasibility, practicality, and scientific basis of all laws; connect law creation with law enforcement; and communicate, disseminate, spread, and promote HCM ideology, morality, and lifestyle in legislation and in building Vietnam’s law-governed socialist state.

In conclusion, Chairman Hue said, applying and promoting the invaluable achievements of HCM ideology in legislation, reforming NA activities, and improving the role of the NA, the highest representative of the people and Vietnam’s highest state power agency, are the keys to successfully making Vietnam a law-government socialist State.
